Protect the Brand on the Shelf

Food brands compete on names, packaging, and label claims, and many export through Miami to Latin America. We clear and register food marks, protect packaging, review label claims, and extend protection abroad.

Spotlight · Food and beverage trademark team

Miami food brands, from the corner shop to the supermarket shelf

Our food and beverage trademark team represents snack makers, restaurant groups, bakeries, grocers, dessert shops, coffee roasters, and Spanish food producers entering the U.S. We clear and register house brands, product lines, and restaurant names, and keep the registrations in force as businesses grow.

Five top recommendations

What we recommend for food brands

Our five most important steps for protecting a brand in this industry, in the order most clients need them.

1

Separate the brand from the product name

Use a distinctive brand with a descriptive product name, such as BRAND Guava Pastries, rather than a name that only describes the food.

2

Register in the classes you will sell in

Many food brands need Class 29, 30, 32, and 43 coverage. File for what you sell and what you will sell next.

3

Protect the package, not just the name

Document distinctive packaging and consider a trade dress registration once it is established.

4

Check every label claim

Review 'natural,' 'organic,' 'Made in USA,' and health claims before printing labels.

5

File abroad before you export

Use the Madrid Protocol or national filings in your export markets before you ship, especially in first-to-file countries.

How we counted. USPTO trademark records, retrieved October 28, 2026. The USPTO does not classify filings by industry, so this page counts: Applications naming Class 29 (meat, dairy, and prepared foods) or Class 30 (coffee, snacks, bakery, and sauces). An application is counted once even if it names several qualifying classes.

Questions

Frequently asked questions

Can I trademark a recipe?

No. Recipes can be protected as trade secrets. The brand name and packaging can be trademarks.

Can I use a place name in my food brand?

If the place describes where the food comes from, the name is refused unless it has acquired distinctiveness. Use it as a secondary element.

Can I protect my packaging?

Yes, if it is distinctive and not functional. Packaging can qualify without proof of acquired distinctiveness.

When can I say 'Made in USA'?

Only when all or virtually all of the product is made in the U.S., under the FTC's standard.

How do I protect my brand in Latin America?

File in each country before you export. Mexico, Colombia, Chile, and Brazil are Madrid members; others require national filings.

What classes should a food brand file in?

Class 29 or 30 for most foods, Class 32 for beverages, Class 35 for retail, and Class 43 for restaurant services.
