Legacy · Florida citrus

A long record with Florida's citrus industry

Florida citrus has been part of this firm's practice for decades. USPTO records list Allen Dyer Doppelt + Gilchrist attorneys on 75 trademark applications for citrus and agriculture organizations, on marks first filed as early as 1948, and on marks the firm still maintains today: the Florida Department of Citrus's consumer marks, grower cooperatives' fruit brands, industry promotion campaigns, and the products growers use to protect their groves.

What the team does for agriculture brands

  • Box, label, and brand. Registrations for the brand on the carton and the label, kept separate from variety and product names, which cannot be registered.
  • Foreign registrations put to work. Section 44(e) filings, as for VALDERRAMA and IBERITOS, let a registration from home support a U.S. registration before U.S. sales begin.
  • Importer and grower aligned. Ownership is placed with the right company, the grower abroad or its U.S. importer, and assignments are recorded when it changes.
  • Maintenance. Renewals and Section 8 and 15 declarations keep long-running brands such as ELITE FLOWER and INCA BANANAS in force.

Who the team works with

  • Flower growers and importers using Miami International Airport
  • Fresh-produce importers and distributors in South Florida
  • Seafood, meat, and poultry producers and traders
  • Spanish and Latin American food and olive oil producers entering the U.S.
  • Florida citrus, nursery, and specialty growers

Five top recommendations

What we recommend for agriculture brands

Our five most important steps for protecting a brand in this industry, in the order most clients need them.

1

Separate the brand from the variety

Use a trademark alongside the variety name, never in place of it. The variety name must stay available to everyone.

2

Register labels and box designs

Produce sells by label and box. Register the label design as well as the word mark.

3

Protect new varieties separately

Use plant patents or Plant Variety Protection for new varieties, and coordinate them with your brand.

4

File in export markets

Register in the countries where you sell before shipping, especially in first-to-file systems.

5

Record with CBP

Recordation helps stop counterfeit labels and products at the border.

How we counted. USPTO trademark records, retrieved October 28, 2026. The USPTO does not classify filings by industry, so this page counts: Applications in Class 31 whose goods mention fresh fruits, fresh vegetables, fresh citrus, seeds, live plants, or unprocessed coffee. An application is counted once even if it names several qualifying classes.

Questions

Frequently asked questions

Can I trademark my plant variety's name?

No. A variety name is treated as generic. Use a separate trademark for marketing the variety.

How are new plant varieties protected?

By plant patents for asexually reproduced plants, or Plant Variety Protection certificates for seed-propagated varieties.

Can I use 'Florida' in my brand?

As a secondary element. A geographic term describing where produce comes from is not registrable on its own without acquired distinctiveness.

Do I need to register in the countries I export to?

Yes. U.S. registration does not protect the brand abroad.

Can I register my box label?

Yes, as a design mark, if it is distinctive.

What class are fresh produce and plants in?

Class 31. Processed foods are in Classes 29 and 30, and coffee in Class 30, or Class 31 if unroasted.
