Protect the Product, Not Just the Name
Housewares, toys, and everyday products are copied by retailers, marketplace sellers, and importers. We protect names, packaging, and product designs, and stop knockoffs online and at the border.
What consumer product brands run into
Miami's importers, distributors, and e-commerce sellers handle large volumes of consumer products from Asia and Latin America.
Retail and Amazon knockoffs
Lookalike products appear quickly on marketplaces and in stores.
Amazon Brand Registry →Problem 2Packaging and product design
Packaging and distinctive product shapes can be protected as trade dress.
Federal Trade Dress →Problem 3Import counterfeits
Counterfeit consumer products enter through ports and express shipments.
U.S. Customs (CBP) Recordation →Problem 4Copied photos and listings
Sellers copy product photos and descriptions, which can be removed with DMCA notices.
DMCA Takedowns →Robrady design and the ZIIVAA product line
ZIIVAA is a line of non-prescription compression products for relief of menstrual cramping, developed with Sarasota product-design firm Robrady design. Our team built the line's U.S. trademark portfolio around the product name, its tagline, and the name of its adjustable-compression technology, and has kept every registration in force through renewal.

Protecting a designed product, not just its name
- Product name in two classes. ZIIVAA is registered for the device in Class 10 and for online retail of women's health products in Class 35, covering both the product and the store that sells it.
- The technology as a brand. A.C.T. and ADJUSTABLE COMPRESSION TECHNOLOGY name the feature that sets the product apart, so competitors cannot borrow the name of the innovation.
- The tagline. LIVE YOUR LIFE protects the line's marketing message for the same goods.
- Ownership in an IP company. All registrations are held by Ziivaa IP, LLC, a holding company that can license them, including the two first filed by the line's original operating company.
- Long-term maintenance. All six registrations have been renewed, keeping protection in place more than a decade after launch.

Laser Pegs Ventures: building the brand portfolio for a lighted construction toy
Laser Pegs is a construction toy built from translucent blocks that light up when connected to a power source. For nearly a decade our trademark team built the U.S. portfolio behind it for the Laser Pegs ventures, its Florida developer Capriola Corporation and later Laser Pegs IP Holdings Corp.: the toy line and its sets, the companion app and online community, accessories, and the related iStory animation venture.

Every application filed by our team for the Laser Pegs family of brands.
Filings peaked in 2012, when the product line expanded into new sets, an app, an online community, and accessories.

How the portfolio was built
- Product names and set names. Separate registrations for sets and lines such as 3D LITE BOARD, WORLD OF BUGS, RUNNERS, and PEG HEADS let each be marketed and licensed on its own.
- Taglines. THE ULTIMATE TOY FOR KIDS and THE ULTIMATE APP FOR KIDS protected the brand's marketing lines.
- Beyond the box. Filings for the app, the LP NETWORK online community, and LASER LACES followed the brand into software, online services, and accessories.
- Intent-to-use filings. Most applications were filed on an intent-to-use basis, giving new sets and products a priority date before they reached stores.
Trade dress and what came next
- Trade dress. USPTO records show no trade dress (product shape or configuration) applications for the Laser Pegs blocks. The brand's federal protection rested on its word and design marks.
- Logo marks. Two design registrations, for the LP NETWORK and LASER LACES logos, protected the brand's graphics as well as its names.
- Later ownership. The core LASER PEGS registration, first issued to Capriola Corporation in 2010, has since passed to new owners and remains registered and renewed today.
- Lapsed registrations. Registrations for discontinued products and services were later cancelled under Section 8 as the product line changed.

What we recommend for consumer product brands
Our five most important steps for protecting a brand in this industry, in the order most clients need them.
Register the brand before manufacturing
File before you place production orders, especially if you manufacture abroad.
Pair trademarks with design patents
Design patents cover new designs right away; trade dress protection builds over time.
Record with CBP
Recordation lets Customs detain counterfeit imports before they reach the market.
Protect your listings
Enroll in Brand Registry, register copyright in key photos, and use DMCA notices against copied listings.
Register where you manufacture
Filing in the manufacturing country, often China, helps stop knockoffs at the source.

How we counted. USPTO trademark records, retrieved October 28, 2026. The USPTO does not classify filings by industry, so this page counts: Applications naming Class 21 (housewares and kitchenware), or Class 28 applications for toys, excluding gaming and slot machines. An application is counted once even if it names several qualifying classes.

What the law says
- Product-design trade dress requires proof of acquired distinctiveness (Wal-Mart v. Samara Brothers, 2000), and functional features cannot be protected at all (TrafFix Devices v. Marketing Displays, 2001).
- Design patents protect new ornamental designs and are often the fastest route against knockoffs of a new product.
- Product photos and written descriptions are protected by copyright, which supports DMCA takedowns.

Frequently asked questions
Can I protect my product's shape?
As trade dress, only after it acquires distinctiveness and if it is not functional. Design patents can protect a new design right away.
How do I stop knockoffs on Amazon?
Brand Registry, design patent and trade dress claims, and DMCA notices for copied photos.
Should I register in China?
If you manufacture there, yes. China is first-to-file, and registration helps stop copies at the source.
Can Customs stop counterfeits?
Yes, once the registration is recorded with U.S. Customs and Border Protection.
What is the difference between trade dress and a design patent?
Trade dress protects a distinctive look that identifies the source, potentially forever. A design patent protects a new ornamental design for 15 years.
Do I need a lawyer for DMCA takedowns?
Not always, but a lawyer helps with repeat infringers and counter-notices.
