Protect the Brand, Support the Claim
Supplement brands face crowded names, competitor claims suits, and counterfeit and diverted products online. We clear and register supplement marks, defend and bring false-advertising claims, and act against counterfeits.
What supplement brands run into
South Florida is a major center for supplement manufacturing, private labeling, and export to Latin America.
Crowded, descriptive names
Names built from ingredients or benefits, such as 'immune' or 'keto,' are refused or easy to copy.
Federal Trademark Applications →Problem 2Competitor false-advertising suits
Health and performance claims are a frequent target of competitor lawsuits.
False Advertising Litigation →Problem 3Florida consumer claims
Florida's Deceptive and Unfair Trade Practices Act allows claims over misleading labels and marketing.
FDUTPA Litigation →Problem 4Counterfeit and diverted products online
Counterfeit and expired supplements are sold on marketplaces under the brand's listings.
Counterfeiting Claims →Designs for Health: stopping diverted supplements on Amazon
Designs for Health sells its supplements through licensed health-care practitioners. When products began appearing on an Amazon storefront with their bar codes and expiration dates removed, our team brought a federal counterfeiting and infringement case in Miami.
How the case unfolded
- Oct. 24, 2017●
Complaint filed for counterfeiting, willful trademark infringement, and trade dress infringement, with a motion for preliminary injunction and expedited discovery.
- Early 2018●
Stipulated consent preliminary injunction stops the sales while the case proceeds.
- Discovery●
Expedited discovery traces the supply to a network of buyers who opened practitioner accounts to obtain products for resale. The complaint is amended to add parties.
- June 8, 2018★
Consent final judgment and permanent injunction; the defendants agree to pay $220,000.
Why genuine products can still infringe
- Material differences. Goods sold without bar codes, lot tracking, or expiration dates are not the same as the genuine product, and their sale can infringe even if the contents are authentic.
- Quality control. A brand that sells only through practitioners controls storage, handling, and recalls. Diverted products escape those controls.
- Follow the supply. Expedited discovery identifies who is supplying the reseller, so enforcement reaches the source, not just one storefront.
- Lasting relief. A permanent injunction lets the brand return to court quickly if the sales resume.

Why the portfolio is built this way
- Word and design marks. The word registration protects DOUBLE WOOD in any style; the design registration protects the logo on the label.
- The short forms customers use. DW and DWS cover the abbreviations used on packaging and by customers, closing a gap that knockoff sellers exploit on marketplaces.
- Product-line marks. A separate registration for a product line, such as DHM DEPOT, protects products that are marketed on their own.
- Maintenance. Section 8 and 15 filings keep the earliest registrations alive and make them incontestable.

What the portfolio shows
- House brand in two forms. RSP and RSP NUTRITION are registered separately, so the short form used on packaging is protected on its own.
- Product names that sell. FAST FUEL, QUADRALEAN, TRUEFIT, and AMINOLEAN protect the product names customers search for on Amazon and in stores.
- New formats. AMINOLEAN is registered in Class 32 for drink powders, following the product into the beverage category.
- A focused portfolio. Marks for discontinued products have been allowed to lapse, so maintenance is spent on products in the market.

What we recommend for supplement brands
Our five most important steps for protecting a brand in this industry, in the order most clients need them.
Pick a brand name that is not an ingredient or benefit
Distinctive names register more easily and are easier to enforce than names built from ingredients or benefits.
Search for pharmaceutical conflicts too
The USPTO compares supplement names with drug names, so clearance should cover Class 5 pharmaceuticals as well.
Keep substantiation behind every claim
Keep the studies behind each claim on file, and make sure they match the product, dose, and wording on the label.
Control your sales channels
Authorized-reseller agreements and Brand Registry help stop diverted, expired, and counterfeit products.
Watch competitor claims
Track competitors' claims. Unsupported claims can be challenged through demand letters, NAD, or litigation.

How we counted. USPTO trademark records, retrieved October 28, 2026. The USPTO does not classify filings by industry, so this page counts: Applications in Class 5 whose goods mention dietary or nutritional supplements. An application is counted once even if it names several qualifying classes.

What the law says
- Competitors can sue over misleading labels under the Lanham Act even where FDA rules also apply (POM Wonderful v. Coca-Cola, 2014).
- Supplements may make structure-function claims, such as 'supports joint health,' with an FDA disclaimer and notice. Claims to treat or prevent disease make the product an unapproved drug.
- The FTC requires competent and reliable scientific evidence for health claims, as set out in its 2022 Health Products Compliance Guidance.

Frequently asked questions
Can I trademark an ingredient name?
Not as a brand for products containing that ingredient. The name of the ingredient is generic or descriptive.
Why was my supplement name refused because of a drug?
The USPTO treats supplements and pharmaceuticals as related, so a similar drug name can block a supplement mark.
Can a competitor sue me over my label?
Yes. Under POM Wonderful v. Coca-Cola, Lanham Act claims are available even where FDA regulates the label.
What is a structure-function claim?
A claim that a supplement supports a normal body function. It needs a disclaimer and FDA notice, and it cannot claim to treat a disease.
How do I stop diverted products on Amazon?
Brand Registry, authorized-reseller agreements, and, where products differ from genuine ones, infringement claims.
Does Florida law apply to supplement marketing?
Yes. FDUTPA allows claims over deceptive marketing to Florida consumers.
