Protect the Brand Behind the Listing
Online sellers deal with hijacked listings, IP complaints, Schedule A lawsuits, and copied photos. We register e-commerce brands for marketplace programs, enforce against hijackers, and defend sellers against complaints and suits.
What e-commerce brands run into
Florida has one of the largest concentrations of Amazon and marketplace sellers in the country, including many selling to and from Latin America.
Hijacked listings
Other sellers take over listings or sell counterfeits under your brand.
Amazon Brand Registry →Problem 2IP complaints against your store
Rights owners file complaints that can suspend listings or accounts.
Schedule A Disputes →Problem 3Schedule A lawsuits
Sellers are sued in batches with accounts frozen before notice.
Schedule A Disputes →Problem 4Copied product photos
Competitors reuse your photos and descriptions.
DMCA Takedowns →What we recommend for e-commerce brands
Our five most important steps for protecting a brand in this industry, in the order most clients need them.
File before you list
A pending USPTO application is enough to enroll in Brand Registry, so file before your first listing.
Register the brand, not the product name
Marketplaces enforce brand names. Register the name that appears on the product and packaging.
Respond to complaints quickly
Answer IP complaints and Schedule A suits immediately. Delay can mean suspended accounts and default judgments.
Keep records of your supply chain
Invoices and authorization letters are your defense against counterfeit and authenticity complaints.
Register copyright in key photos
Registered photos support stronger DMCA notices and, if needed, litigation.

How we counted. USPTO trademark records, retrieved October 28, 2026. The USPTO does not classify filings by industry, so this page counts: Applications in Class 35 whose services mention online retail store services. An application is counted once even if it names several qualifying classes.

What the law says
- Amazon Brand Registry requires a registered trademark, or a pending application, from a government office in a country where Amazon has a store. For Amazon.com, that is the USPTO.
- Schedule A cases are filed against many sellers at once, often in the Northern District of Illinois, with temporary restraining orders that freeze marketplace accounts.
- Product photos are protected by copyright, and DMCA notices remove infringing copies from platforms.

Frequently asked questions
Do I need a registered trademark for Brand Registry?
A pending application is enough to enroll in the U.S. Brand Registry, though some tools require registration.
What is a Schedule A case?
A lawsuit against many sellers listed on a 'Schedule A,' usually with an order freezing their accounts.
My account was frozen by a lawsuit. What do I do?
Contact counsel right away. There are short deadlines, and options include challenging the order or negotiating a release.
Can I sell genuine products from another brand?
Generally yes under the first-sale doctrine, but not if they differ materially or you imply authorization.
How do I remove copied photos?
Send a DMCA takedown notice to the platform. Registered copyright strengthens your position.
What is listing hijacking?
When another seller takes control of your listing or sells counterfeits under it. Brand Registry tools address it.
